INEC Has Power To Deregister Political Parties – Court

A Federal High Court sitting in Lagos on Wednesday dismissed a suit filed by the National Conscience Party challenging the constitutionality of the power of Independent National Electoral Commission, INEC, to deregister political parties; the court ruled that the INEC has valid power to de-register political parties which failed to meet specified requirements.

Justice Okon Abang, in his judgment, affirmed the constitutionality of Section 78(7)(2) of the Electoral Act which makes it mandatory for parties to win election for them to be accorded recognition by INEC.

Joined as defendants in the suit were the National Assembly and the Attorney-General of the Federation, Mr. Mohammed Adoke, who was not represented throughout the hearing of the matter.
