Anambra Poll: PDP Anointed Candidate, Nwoye Withdraws Suit Against Party, INEC

The Federal High Court on Monday in Abuja granted an application to withdraw a suit by a Peoples’ Democratic Party, PDP, Anambra governorship candidate, Mr Tony Nwoye, on his candidature.

Giving the ruling, Justice Elvis Chukwu held that the order was predicated on an application brought before the court by the plaintiff.

“In view of the application filed by Mr Alex Akoja on behalf of the plaintiff, I hereby grant an order for the withdrawal of the suit,” he said.

Addressing the court on the motion, Akoja said that the withdrawal became imperative to pave the way for the pursuit of an appeal on the decision of the Port Harcourt jurisdiction of the court.

Justice Suleiman Aliyu of the Port Harcourt Federal High Court, had in a judgment on a case bothering on the candidacy, upheld Nicholas Ukachukwu as the governorship candidate of the PDP.

Chukwu had at the last sitting, reserved Sept. 30 for counsel to Nwoye, the INEC and PDP to address it on the implication of the judgment on the suit.

Justice Chukwu ordered counsel to the parties to address the court on the matter.

On Sept. 17, hearing in the suit was derailed when Ukachukwu, through his counsel, Mr Orji Orizu, applied to be joined as a respondent.

Orizu had announced to the court of an ongoing judgment in the Port Harcourt jurisdiction over a similar matter.

He told the court that his client had approached the court, seeking to be upheld as the governorship candidate of the party. (NAN)
