Man Drags 7 Brothers To Court Over Father’s Will

Nine brothers were on Wednesday before an Upper Customary Court in Sabon Tasha, Kaduna over their late father’s will.

The petitioner, Bitrus Yohanna had dragged the other seven brothers to court claiming that they refused to abide by the Will their father had left behind.

According to Bitrus, after their father died, one of his uncles discovered the will.

He said the father left behind two houses and farmlands in the village.

Bitrus said the will left one of the bigger houses which had eleven rooms to the seven brothers, while the house with 9 rooms was for him and his brother.

Ishaya Yohanna, the eldest son of the deceased and one of the seven respondents, explained to the court that the father had three wives, of which one had six male children, the other had two and the last woman had one child.

While not denying the existence of a Will, Ishaya said they objected to the Will because it was “unfair and not right” that seven of them should share 11 rooms while only two people would take a house with nine rooms.

The Judge, Mrs Dorothy Inwulale adjourned the case to January 22, 2012 for continuation of hearing citing the matter as sensitive. She said since it was the first hearing she would not rule on the application.
