A judge of High Court, Justice Amelia Tee Hong Geok Abdullah, handed down the decision on Wednesday after the defence had failed to raise reasonable doubt in Uchechukwu Nelson Ohaechesi’s case.

According to the judge, the court found that Ohaechesi, 37, was not a witness of truth. She said the accused’s defence was an afterthought, a pure fabrication and untrue.

She said the court also considered the evidence of the accused in totality to determine if the defence raised by him has nevertheless cast a reasonable doubt as to the truth of the prosecution’s case.

“The court therefore sentences the accused to death and vide Section 183 of the Criminal Procedure Code, the accused is to be hanged by the neck until he is dead,” she said.

Ohaechesi was accused of trafficking 26,533 grams of cannabis beside an overhead bridge staircase at Taman Connaught Highway (Kajang bound) in Cheras at about 7.45pm on Oct 17, 2010.

A total of seven prosecution witnesses were called to testify while the defence only one witness.
